What is Estate Planning?

Estate Planning is about protecting your family's future. A comprehensive estate plan will provide you with 5 key benefits:

  1. Peace of Mind. An estate plan puts your intentions in writing to ensure that your wishes are followed. By having your intentions in legally binding documents, you can rest easy knowing that your family has clear and proper legal instruction for a variety of scenarios that may arise in the future.

  2. Avoid Probate. Probate is a public court process that no family should ever have to go through. With the right estate planning, your family can avoid months (sometimes years) of unnecessary delays and legal fees while maintaining your privacy.

  3. Minimize Estate Taxes. Massachusetts has an estate tax on estates over $2 million (this includes life insurance, retirement accounts, and equity in your home). However, with proper planing you can minimize or potentially eliminate the Massachusetts estate tax. For example, married couples can effectively double their exemption by setting up separate trusts. New Hampshire doesn’t have an estate tax at the state level, but if you live in New Hampshire and have property located in Massachusetts, then you may still be subject to an estate tax on the proportionate value of property held in Massachusetts.

  4. Protect Your Children’s Inheritance. A good estate plan will make sure the money and property you leave to your children isn’t wasted by frivolous spending, poor management, or attachment by creditors (e.g., divorce, bankruptcy, litigation). For young families, you’ll also want to make sure the right guardian, conservator, and trustee provisions are in place to ensure your minor children are well-taken care of.

  5. Maintain Family Harmony. Successful estate plans often go unrecognized because they do what they are supposed to do: make things easy. Meanwhile bad estate plans get all the headlines and often lead to family members arguing over real estate and other family assets. There’s no reason to let a family fall apart over money. A well-drafted estate plan makes sure everyone knows exactly what they are getting and leaves no room for confusion.

So what does an estate plan consist of?

There are four key documents to a common estate plan in Massachusetts and New Hampshire:

  1. Family Trust (Revocable Living Trust)

  2. Pour-Over Will

  3. Durable Power of Attorney

  4. Health Care Proxy / Advance Directive

With these estate planning documents in place, you can rest easy knowing that everything will be taken care of if something were to happen to you. You can help your family avoid unnecessary delays, taxes, legal fees and expenses; and you can make sure the right things go to the right people at the right time.

Peace of mind starts here.

CLIENT TESTIMONIALS

“My husband and I didn’t know where to start when it came to Estate Planning. While we knew some basics and what we’d like to do, the process was completely foreign to us. We found Joe and he was exactly what we needed. He was patient with all our questions, explained everything to us in a way that made sense, and made sure everything was completed smoothly. I can’t recommend him enough and look forward to working with him for years to come!”

— Jen (Stoneham, MA)

“I am so pleased I chose Joseph M. Lento for my estate planning. At our first meeting he went over the process and what would be included in estate planning. My questions were answered before I even asked them. He explained the documents that would be needed and which ones he would be filing. We received drafts to review and then scheduled an appointment to come in and sign the paperwork. He then followed up with an email as to what I should follow up with now the documents were filed. The entire experience was seamless. It was a pleasure working with him. I would highly recommend Joseph Lento to anyone in need of an attorney for estate planning.”

— Dolores (Stoneham, MA)

“Attorney Joseph Lento is outstanding and epitomizes every sense of the meaning a ‘true professional.’ My husband and I worked with him on several matters. He is not only extremely knowledgeable, organized and timely, but also generous with his time, explained everything in depth and made certain we understood every detail. He handled a situation that was difficult for us and executed it with ease, expertise, kindness and compassion. We honestly felt that we were in the right hands and well taken care of. We highly recommend attorney Joseph Lento!”

— Elaine (Wakefield, MA)

“I was searching for an Attorney to assist with my mother’s Estate Planning when I came across Joe’s name recommended in a Facebook post on a local page. I had already met with 3 other Attorney’s but each left me overloaded with legal jargon, an astronomical cost estimate, concern that they were not providing the best advice based on our circumstances, and/or the clear impression they were very busy and didn’t have time to educate and explain the process as well as complete our documents. From my 1st outreach to Mr. Lento he was very personable, easy to talk to, took the time to explain all options in detail to us and the caveats of each, offered us guidance as well as shared his recommendations as to how we should handle each part of the Estate Planning. I knew right from that phone call that he was the right Attorney for us. He was then quick to respond to all the questions I emailed him. He was very accommodating of my mother who lives an hour away and isn’t savvy with email so instead took the time to speak with her over the phone as well... I’m 100% confident we received significantly better and more valuable service than we would’ve from any of the other Attorneys and ended up paying 1/3 of what others were trying to charge me. If I knew it could’ve been this easy, I wouldn’t have procrastinated for about a year and a half! Hopefully this will save someone else the time and stress trying to decide on an Estate Planning Attorney. I’d highly recommend your search stops here. Thanks for everything!”

— Jennifer (Wakefield, MA)

“Excellent Service. I had Attorney J Lento draw up a Family Trust for my wife and I. The process was swift, questions we had were readily resolved. J Lento was very knowledgeable and professional. We found him because my sister-in-law had hired him for similar services and she was very happy as well. I would recommend him to others.”

— Michael (Woburn, MA)

“Joe set up a revocable trust, will, power-of-attorney, and healthcare proxy for me, all with minimal fuss or busy work. I had an initial meeting with him to go over my personal situation and goals, and he clearly explained the purpose of each legal agreement, how they worked, and what the steps would be to get them filed. He then prepared all the paperwork, sent them to me for review, and finally met in person with me to sign. It was quick, easy, and complete. He delivers all of the executed agreements in super handy organizer, and is always available to answer questions. I've worked with lots of lawyers, and this experience was top-notch.”

— Kris (Stoneham, MA)

“Joe made the whole process of estate planning so painless and easy that we wondered why we had not done it before. We would recommend Joe to anyone in need of excellent service at a reasonable price.”
